Please read these Terms of Service ("Terms") carefully before using CheckMyCars ("Service," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using CheckMyCars, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will use the Service only for lawful purposes
  • You agree to comply with all applicable Australian laws and regulations

2. Description of Service

CheckMyCars provides:

  • Free VIN Check: Basic vehicle information and recall data
  • Basic PPSR Report: Official PPSR search results and vehicle identity details, delivered as a downloadable PDF via email
  • Premium Report: Everything in Basic, plus market valuation (when available), insurance claims repair history (when available), and used-car marketplace listing history (when available)
  • Report Bundles: Prepaid credits that can be redeemed for Premium reports within the stated validity period
  • Sample Reports: Illustrative PDFs for demonstration only — not live vehicle data and not a substitute for a paid report

Premium add-on sections depend on third-party data sources and may be incomplete or unavailable for some vehicles. A paid report remains valid for its included PPSR search even if an optional Premium section cannot be produced.

3. Payment and Pricing

3.1 Fees

  • Basic PPSR reports are charged at $6.99 AUD per report
  • Premium reports are charged at $14.99 AUD per report
  • Bundles (where offered) are charged at the price shown at checkout (currently $100 AUD for 10 Premium report credits, valid for 365 days unless otherwise stated)
  • The price displayed at checkout for your selected product is the price you pay
  • Payment is processed securely via a third-party payment processor
  • All prices are in Australian Dollars (AUD)
  • Prices are subject to change without notice

3.2 Refund Policy

Due to the instant nature of digital delivery, all sales are final. Refunds are provided only in the following circumstances:

  • Technical error preventing report delivery
  • Duplicate charges for the same VIN
  • Report data is demonstrably incorrect (verified by official PPSR)

Unavailable or incomplete optional Premium sections (such as valuation, claims repair history, or listing history) for a specific vehicle do not automatically entitle you to a refund where the PPSR search and core report were delivered successfully.

To request a refund, contact us within 7 days of purchase via our contact form. Approved refunds are processed within 5-10 business days to the original payment method.

4. Report Delivery and Access

  • Reports are delivered to the email address provided at checkout
  • Delivery typically occurs within 5 minutes of purchase
  • Download links are valid for a limited time
  • You are responsible for saving the PDF report to your device
  • We are not responsible for undelivered emails due to spam filters or incorrect email addresses

5. Accuracy and Limitations

5.1 Data Sources

CheckMyCars sources data from:

  • Australian Government PPSR database
  • Vehicle identification and specification databases
  • Australian and international vehicle recall databases
  • Industry claims repair history (motor insurance repair quotation data)
  • Licensed Australian market valuation data
  • Used-car marketplace listing history data (where available)

5.2 Disclaimer of Warranties

IMPORTANT: While we strive for accuracy, we provide the Service "as is" without warranties of any kind.

  • We do not guarantee the accuracy, completeness, or timeliness of data
  • Data accuracy depends on third-party sources (including government and licensed industry databases)
  • Reports represent a snapshot at the time of generation
  • We are not liable for decisions made based on report data
  • Reports do not replace professional vehicle inspections

5.3 Claims Repair History

Premium reports may include Claims Repair History data. Please note:

  • This data is sourced from industry partners and may not include all insurance repair records in the Australian market
  • The information is based on repair quotations only — it does not confirm whether the quoted repairs were approved by the insurer or if the work was carried out
  • The history is tied to the Vehicle Identification Number (VIN), providing information about the vehicle itself, not the owner or driver
  • The absence of claim records does not guarantee a claim-free history
  • Claims Repair History is provided for informational purposes only and should be used as one of several data points when assessing a vehicle
  • This service is provided under the terms of our data partners

5.4 Market Valuation

Premium reports may include a market valuation estimate. Please note:

  • Valuations are indicative estimates only and are not a formal appraisal, bank valuation, or guarantee of sale price
  • Estimates depend on available market data, vehicle matching, and (where provided) odometer information
  • A valuation may be unavailable for some vehicles (including certain commercial, specialist, or poorly matched models)
  • Price ranges and confidence indicators, where shown, are estimates and may change over time
  • Do not rely solely on a valuation when buying, selling, or financing a vehicle

5.5 Marketplace Listing History

Premium reports may include used-car marketplace listing and price history. Please note:

  • Coverage is limited to marketplaces and periods included in our data sources and may be incomplete
  • The absence of listing history does not mean the vehicle was never advertised for sale
  • Listed prices, odometer readings, and dates are as recorded in source data and may contain errors or omissions
  • Listing history is informational only and does not confirm the vehicle's actual sale price or condition

5.6 What Reports Do NOT Include

  • Mechanical condition or roadworthiness
  • Service history or maintenance records
  • A complete accident or police crash history (PPSR/NEVDIS write-off status and optional claims repair quotations are not a full accident history)
  • Ownership history
  • Odometer accuracy or verification

We strongly recommend obtaining a professional pre-purchase inspection before buying any used vehicle.

6. User Responsibilities

You agree to:

  • Provide accurate information (VIN, registration, email address)
  • Not use the Service for illegal or unauthorized purposes
  • Not attempt to reverse engineer, decompile, or hack the Service
  • Not resell, redistribute, or republish reports without authorization
  • Not use automated tools (bots, scrapers) to access the Service
  • Not submit excessive or fraudulent requests

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW:

  • CheckMyCars is not liable for any indirect, incidental, special, or consequential damages
  • Our total liability for a purchase is limited to the amount you paid for that purchase
  • We are not responsible for decisions made based on report data
  • We are not liable for losses arising from vehicle purchases
  • We are not responsible for third-party service failures (payment processors, email services, government databases, or licensed data providers)

Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under Australian Consumer Law.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on CheckMyCars are owned by us or our licensors. You may not:

  • Copy, reproduce, or redistribute our content without permission
  • Use our trademarks or branding without authorization
  • Claim ownership of our content or reports
  • Modify, adapt, or create derivative works

Reports are for personal use only. Commercial use requires separate licensing.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using CheckMyCars, you consent to the collection and use of your information as described in the Privacy Policy.

10. Termination

We reserve the right to:

  • Suspend or terminate access to the Service at our discretion
  • Refuse service to anyone for any reason
  • Remove or disable content that violates these Terms
  • Take legal action against users who violate these Terms

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

Before taking legal action, you agree to attempt to resolve disputes informally by contacting us via our contact form.

13. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:

  • A refund or replacement if services are not provided with acceptable quality or skill
  • Compensation for foreseeable loss or damage caused by our failure to provide services with acceptable quality

Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law or other applicable laws.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CheckMyCars regarding use of the Service.
